1. General
These Terms & Conditions govern your use of the EVVY platform ("Service") operated by EVVY ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these terms. If you disagree with any part, you may not use the Service. We reserve the right to update these terms at any time; continued use constitutes acceptance of the revised terms.
2. Services
EVVY provides AI-assisted business intelligence and content generation services, including lead discovery, SEO content packs, investor matching, and social media content. All outputs are generated using artificial intelligence and curated by human operators before delivery. We do not guarantee any specific business outcome from the use of our outputs. Service availability is provided on a best-effort basis.
3. Payment
All prices are listed in US dollars (USD) and are exclusive of any applicable taxes. Payment is processed securely via Stripe. By placing an order you authorise the charge to your payment method. Orders are non-binding until payment is confirmed. For EU customers, VAT may be applied in accordance with applicable regulations. Invoices are available on request from your dashboard.
4. Delivery
Estimated delivery times are shown at the point of purchase and are indicative only. Complex or high-volume orders may take longer. Delivery is deemed complete when the result is made available in your dashboard. We will notify you by email when your order is ready. EVVY is not liable for delays caused by circumstances beyond our reasonable control.
5. Refunds
Due to the digital and custom nature of our services, all sales are final once an order has been delivered. If the delivered output materially fails to meet the stated scope (e.g. significantly fewer leads than ordered), we will re-run the task at no extra charge or issue a credit. Refund requests must be submitted within 7 days of delivery via hello@getevvy.ai. We do not issue refunds for dissatisfaction with AI-generated content style or subjective quality.
6. User Obligations
You agree to: (a) provide accurate information when placing orders; (b) use outputs solely for lawful business purposes; (c) not resell or redistribute outputs without prior written consent; (d) not use the Service to harass, spam, or engage in any unlawful activity; (e) maintain the confidentiality of your account credentials. You are responsible for all activity under your account.
7. Intellectual Property
Upon full payment, you receive a non-exclusive, worldwide licence to use the delivered outputs for your own business purposes. EVVY retains all rights to the underlying platform, AI models, and methodologies. You may not reverse-engineer or reproduce the Service. Any feedback or suggestions you provide may be used by us without obligation or compensation.
8. Limitation of Liability
To the fullest extent permitted by law, EVVY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profit, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim. Nothing in these terms limits liability for fraud, gross negligence, or death or personal injury caused by our negligence.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland, except where mandatory consumer protection laws in your country of residence apply.
